Terms & Conditions

These Terms & Conditions (“Terms”) apply to the provision of portable appliance testing (PAT) and related services by London PAT Ltd (“London PAT”, “we”, “us” or “our”).

By requesting a quotation, booking our services or instructing us to carry out work, you agree to these Terms.

1. Our Services

London PAT Ltd provides portable appliance testing and related electrical safety services to businesses, organisations and other customers.

The precise services to be provided will be confirmed in our quotation or other written agreement with you.

We will carry out services with reasonable care and skill and in accordance with applicable requirements and relevant industry practices.

2. Quotations

Quotations are provided based on the information supplied to us and, where applicable, the estimated number and type of items requiring testing.

Unless otherwise stated in writing:

Quotations are valid for 30 days.

A quotation is an estimate of the cost of the requested services and is subject to the information provided being accurate and complete.

Additional items or services identified after arrival at the premises may incur additional charges.

The final cost of your testing will be based on the actual number of items tested onsite.

3. Booking and Cancellation

A booking is confirmed once we have agreed a date for the work to be carried out.

If you need to rearrange an appointment, please provide reasonable notice.  If less than 72 hours' notice is given, a further charge may apply.

When a booking has been confirmed by us and you subsequently cancel the booking, we reserve the right to charge a cancellation fee of 50% of the value of the contract plus VAT

 

If an engineer attends the premises and is unable to carry out the agreed work because access is unavailable, the premises are closed, equipment is inaccessible or the necessary arrangements have not been made, we reserve the right to charge a reasonable attendance or cancellation fee.

Where an engineer is required to wait at the premises due to delays outside of our control, including issues with access to the site or where equipment is not ready or accessible for testing, we reserve the right to charge for unreasonable waiting time at a rate of £140 per hour plus VAT

Any applicable cancellation or attendance charges will be communicated to you.

4. Access and Customer Responsibilities

You are responsible for providing our engineer with reasonable access to the premises and to the equipment requiring testing.

You should ensure that:

Equipment is reasonably accessible for testing.

Equipment is available for inspection at the agreed time.

Relevant areas of the premises can be safely accessed.

Any necessary permission to access or test equipment has been obtained.

We are not responsible for delays caused by lack of access, unavailable equipment or circumstances outside our reasonable control.

Server Rooms and IT Equipment

Due to the sensitive nature of equipment located within server rooms, our engineers will not shut down, isolate, restart or power up servers or other critical server-room equipment.

Where a full inspection and electrical test of equipment within a server room is required, the customer is responsible for arranging any necessary shutdown of the equipment prior to our engineer's attendance, and for ensuring that the equipment is safely restored to service following testing.

Where server-room equipment cannot be safely powered down and made available for testing, our engineer may carry out a visual inspection only.

The customer is responsible for ensuring that appropriate data backups and recovery procedures are in place before any testing is carried out. We accept no responsibility for loss of data, interruption to services, loss of functionality or other consequential loss arising from the shutdown, testing or subsequent restart of customer-owned equipment.

The customer should inform us in advance of any equipment that cannot be safely powered down or tested and make appropriate arrangements with their IT provider where necessary.

5. Condition of Equipment

PAT testing involves visual inspection and, where appropriate, electrical testing of equipment.

Testing does not guarantee that equipment will remain safe or operational after the test has been completed.

Where equipment fails a test or is identified as potentially unsafe, we will advise you of the issue.

The customer remains responsible for deciding whether equipment should be repaired, removed from service or replaced.

6. Repairs and Additional Work

Where minor repairs are offered as part of our service, these will be carried out where reasonably practicable and where the repair is considered appropriate and safe.

Where equipment fails testing and requires repair beyond minor repair, the customer will be responsible for deciding whether the equipment is economical to repair or should be replaced.  London PAT Ltd does not undertake further repair or electrical work beyond minor repairs carried out as part of the PAT Testing service.

We reserve the right not to carry out a repair where doing so would be unsafe, inappropriate or uneconomical.

7. Results and Documentation

Following completion of the agreed PAT testing, we will provide a PAT Testing Report and Completion Certificate by email.

The PAT Testing Report and Completion Certificate will be issued following receipt of payment in full, in accordance with the Fees and Payment section of these Terms and Conditions.

The PAT Testing Report and Completion Certificate record the condition of equipment at the time of testing and should not be interpreted as a guarantee of future safety, condition or continued operation.

8. Fees and Payment

Our charges will be stated in our quotation or otherwise agreed with you. Prices are subject to VAT.

Unless otherwise agreed in writing:

We aim to issue invoices within 14 days of completion of the testing.  Unless otherwise agreed, invoices are payable within 30 days of the invoice date.

We reserve the right to charge reasonable costs associated with overdue payments.

If payment is not received by the agreed due date, we may suspend or decline further work until the account is brought up to date.

9. Customer Property

We will take reasonable care when handling equipment belonging to the customer.

However, we are not responsible for pre-existing damage, defects or faults that were not caused by our actions.

Where equipment is particularly fragile, damaged or otherwise unsuitable for testing, we may decline to test it.

10. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation.

Subject to the above, London PAT Ltd will not be liable for indirect or consequential losses, loss of profits, loss of business, loss of revenue or loss of anticipated savings arising from the provision of our services.

Our total liability arising from any particular service shall, where legally permissible, be limited to the amount paid or payable for that service.

Nothing in these Terms removes the customer's responsibility for the proper use, maintenance and ongoing safety of electrical equipment following testing.

11. Delays and Events Outside Our Control

We will make reasonable efforts to provide services on the agreed date.

However, we will not be responsible for delays or failure to perform our obligations where this is caused by circumstances beyond our reasonable control, including severe weather, traffic/travel disruption, illness, equipment failure, utility failure, industrial action or other unforeseen events.

Where reasonably possible, we will contact you and rearrange the appointment.

12. Complaints

If you are dissatisfied with any aspect of our service, please contact us as soon as reasonably practicable.

We will investigate the matter and aim to resolve legitimate concerns fairly and promptly.

13. Data Protection

We process personal information in accordance with applicable UK data protection legislation.

14. Website Information

Information provided on our website is intended to provide general information about London PAT Ltd and our services.

While we make reasonable efforts to ensure that information on our website is accurate and up to date, we do not guarantee that all information will always be complete, current or free from errors.

15. Changes to These Terms

We may update these Terms from time to time.

The latest version will be published on our website and will apply to services agreed after the updated Terms come into effect.

Any specific terms contained in an agreed quotation or written contract will take precedence over these general Terms where there is a conflict.

16. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes arising in connection with these Terms or our services shall be subject to the jurisdiction of the courts of England and Wales, unless applicable law requires otherwise.
